FCA CONC 7.17: Notice of Arrears (NoA): must be issued within 14 days of account falling into arrears. NoA must include information on debt advice services. FCA CONC 7.3: firms must treat customers in arrears with forbearance and due consideration. CONC 7.5: contact frequency: no harassment, FCA expects no more than 3 contact attempts per day and reasonable overall frequency.
FCA CONC 7.9R: forbearance: firms must give customers reasonable time to repay and consider repayment arrangements. CONC 7.14: mandatory free debt advice signposting (StepChange, National Debtline, CAB). Debt Respite Scheme (Breathing Space) Regulations 2020: during breathing space (60 days), all creditor contact and enforcement must stop and interest/charges must be frozen.
FCA CONC 7.7.4R: default charges must not exceed costs reasonably incurred. FCA DISP 1: complaint handling: collections complaints must be handled to the same standard as other complaints, with FOS escalation path. 12 CFR Part 1006 (Regulation F): implements FDCPA for debt collectors, effective November 2021. § 1006.14: telephone call frequency caps: no more than 7 calls per week per debt. § 1006.34: validation information must be provided within 5 days of first communication. § 1006.6: consumer may opt out of electronic communications.
Fair Debt Collection Practices Act (FDCPA) 15 U.S.C. § 1692: § 1692c: cease communication: if consumer requests in writing that collector cease communication, collector must comply (with limited exceptions); § 1692d: prohibition on harassment, oppression, or abuse; § 1692e: false, deceptive, or misleading representations prohibited; § 1692f: unfair practices prohibited. § 1692a(6): first-party BNPL collectors may not qualify as "debt collectors" under FDCPA, but CFPB UDAAP still applies.
Directive 2023/2225/EU (CCD2), Art. 33: default charges must be fair, transparent and proportionate. Art. 35: before initiating court proceedings, creditor must grant consumer a reasonable period and offer restructuring options. CCD2 Recital 71: collections must not be aggressive, coercive, or misleading; UCPD 2005/29/EC applies to pre-litigation collections communications.
